Deferred Disposition

A phone call, fax, or email DOES NOT constitute an appearance.

You must make your request on or before your initial appearance date.  Your request may be made by MAIL or IN PERSON.  Insufficient requests will be denied.  Eligibility requirements listed below.
 

Moving Violations

REQUEST BY MAIL (postmarked by due date):

1)     Proof of valid Driver’s License (NO CDL)
2)     Plea of No Contest or Guilty and waiver of Jury Trial
3)      Special Expense Fee set by Judge plus court costs  
      (CONTACT THE COURT FOR AMOUNT - Check or Money Order payable to Celina Municipal Court)
4)      Request for Deferred Disposition in writing.  (Request Form)

(Necessary paperwork will be mailed to the address on file.)

REQUEST IN PERSON:

  • Proof of valid Driver’s License (NO CDL)
  • Plea of No Contest or Guilty, waiver of Jury Trial
  • Special Expense Fee set by Judge plus court costs  (Check or Money Order payable to Celina Municipal Court; Cash; Visa, MasterCard, Discover – 3% convenience fee applies.)
  •  (Necessary paperwork will be processed at the clerk window at the time of your request.)
             

PROBATIONARY PERIOD:

  • Not to exceed 180 days (1-180 days)

 

CONDITIONS OF DEFERRED:

  • If less than 25 years of age, shall complete State approved Driver Safety Course
  • Provisional Driver License – Complete a DPS-administered Driving Road Test and provide proof of payment of $10.00 fee for test
  • Must comply with any other condition(s) ordered by the Judge

 

Non-Moving Violations

2)     Plea of No Contest or Guilty, waiver of Jury Trial
3)     Special Expense Fee set by Judge plus court costs 
      (CONTACT THE COURT FOR AMOUNT - Check or Money Order payable to Celina Municipal Court) 
4)      Request for Deferred Disposition in writing.  (Request Form) 

(Necessary paperwork will be mailed to the address on file.)
 

REQUEST IN PERSON:

  • Proof of valid Driver’s License (NO CDL) or state-issued ID card
  • Plea of No Contest or Guilty, waiver of Jury Trial

CONDITIONS OF DEFERRED:

  • Must comply with any condition(s) ordered by the Judge

ELIGIBLE AT CLERK WINDOW - MOVING VIOLATIONS:

  • The Defendant shows proof of a valid Driver’s License;
  • The Defendant pays court costs, as determined by the Court’s fee schedule, the special expense fee, and any other fees in full by the specified time;
  • The Defendant is at least 25 years of age, or if less than 25 years of age, shall complete a driving safety course approved under Chapter 1001, Texas Education Code;
  • The Defendant is not a holder of a provisional driver’s license (not restricted, will be required to complete DPS exam);
  • The Defendant has not been granted Deferred in the City of Celina within twelve (12) months of the date of request;
  • The Defendant is not currently on Deferred in the City of Celina or any other jurisdiction.

 INELIGIBLE AT CLERK WINDOW - MOVING VIOLATIONS:

  • The driver is a holder of a Commercial Driver's License (CDL); 
  • The offense occurred in a construction or maintenance work zone when workers were present;
  • The Defendant was involved in an accident resulting in property damage or personal injury;
  • The offense involves passing a school bus;
  • The offense involves failing to obey a school crossing guard; or
  • The offense involves speeding in excess of 30 mph or more over the posted speed limit; excess of 85 mph

ELIGIBLE AT CLERK WINDOW – NON-MOVING VIOLATIONS:

  • The Defendant shows proof of a valid Driver’s License or state-issued ID card;
  • The Defendant pays court costs, as determined by the Court’s fee schedule, the special expense fee, and any other fees in full by the specified time;
  • The Defendant has not been granted Deferred in the City of Celina within twelve (12) months of the date of request;
  • The Defendant is not currently on Deferred in the City of Celina or any other jurisdiction.

INELIGIBLE AT CLERK WINDOW - NON-MOVING VIOLATIONS:

  • The offense is a status offense involving a violation of the Alcohol Beverage Code;
  • The offense is for Driving Under the Influence pursuant to 106.041 of the Alcohol Beverage Code;
  • The offense is a status offense involving a violation of Chapter 161 of the Health and Safety Code (Tobacco);
  • The offense is a violation of the Penal Code without Judge's permission; or
  • The offense involves personal citizen complaints
